- The U.S. Department of Labor proposed revisions to the federal
regulations for "white collar" overtime pay exemptions
under the Fair Labor Standards Act (FLSA) on March 31, 2003. Under
the current FLSA regulations, most workers are guaranteed the right
to overtime pay for every hour worked beyond the normal 40-hour
work week. Under current law, there is a salary-level test, salary
basis test, and a duties test to determine whether an employee is
exempt, and therefore ineligible for overtime. Jeff Roth, a corporate attorney with over
20 years experience,
presents an overview of the current misclassification of employees
as exempt and the proposed changes to the law as well as the recourse
for employers. The Senate failed to pass the proposed changes on September
10, 2003, and President Bush has threatened to veto. Some form of these
changes will, in all likelihood, eventually make it into law.
