Understanding the ADA Amendments Act of 2008

On September 25, 2008, President George W. Bush quietly signed into law the ADA Amendments Act of 2008 (ADAAA), expanding significantly the number of employees covered under the Americans with Disabilities Act (ADA); imposing far greater burdens on employers to explore reasonable accommodations, even for employees not previously considered disabled under the ADA; and increasing - dramatically - the probability of ADA employment claims and an employer’s potential liability exposure for such claims. Worse yet, the ADAAA takes effect January 1, 2009! Can employers really re-learn the ADA in a matter of weeks? Can employers afford not too?

This seminar attempts to assist employers by providing:

  • a firm understanding of both the existing framework of the ADA as of year-end 2008, and the changes to that framework brought about by the ADAAA beginning in 2009;
  • a full appreciation of the many new liability exposures created by the ADAAA;
  • strategies to minimize the increased liability exposures created by the ADAAA.

From a potential liability perspective, the ADAAA may be one of the most significant pieces of federal employment legislation passed in nearly twenty years. Is your company ready for it?
